Dear Sir or Madam,

Re.  Noise and crowd control problems at The Victorian/Basement Tavern, 2640 Main Street, Santa Monica

We are writing to you in support of some of our members, who are not being allowed peaceful enjoyment of their homes.

These members have been seriously affected by the noise and crowd control issues at The Victorian since the owners opened the bar/restaurant/night club in their basement, known as the Basement Tavern, in July 2010.

Whilst accepting that Main Street is now a late night entertainment destination for the city of Los Angeles, we believe that the City should give serious consideration to the noise and crowd problems at The Victorian/Basement Tavern since there are circumstances relating to these premises that are different from the other late night entertainment establishments on Main Street, namely:

1.  The owners use the fire exit at the rear of the premises as the main entrance and exit to Basement Tavern (open until 2am every night) with the result that the crowds entering and leaving are wandering through the parking lot at all hours.  This parking lot is directly adjacent to the residential units at The Shores, 2700 Neilson Way, and Sea Colony III.  No other establishment on Main Street has an entrance and exit on to the rear of their property.

2.  The front patio of The Victorian is open for drinking and partying until 2am.  There is no sound protection around this patio so the crowd noise rises directly towards the above-mentioned residential units.  Again, no other establishment has such an unenclosed patio open so late for the purposes of drinking and partying by their patrons.

3.  The Victorian is exempt from the provisions of Section 4.12.140 of the City Municipal Code relating to Nightclubs, bars and establishments with amplified music because it was permitted before 1992 when these provisions were introduced.  We believe there are sufficient grounds for the City to re-visit these provisions with regard to The Victorian and make it a case for a special Ordinance or other condition since compliance with this Section of the Code would contribute greatly to diminishing the problems caused for our members.

We would like to meet with you to discuss potential mitigations, as the prior efforts have not been successful in improving the situation.
